        Dans le cadre de l"exécution d"une convention de délégation de service public conclue le 2.1.2012 entre la Communauté d"agglomération du centre de la Martinique (Cacem) et le gme «Ensemble pour Mozaïk», dont la CFTU est mandataire, la CFTU a décidé de sous-traiter l"exploitation de 22 lignes régulières de transport public urbain de voyageurs.

        Le titulaire de chacun des lots du marché se verra confier les missions suivantes:

        — l"exploitation du service public de transport urbain de voyageurs sur le périmètre du lot concerné,

        — le transport des personnes à mobilité réduite conformément à la législation,

        — l"investissement en véhicules et leurs équipements,

        — l"entretien et le renouvellement, des véhicules mis en exploitation.

              Référé contractuel (article 11 de l"ordonnance nº 2009-515 du 7.5.2009):

              Les personnes qui ont un intérêt à conclure le présent marché et qui sont susceptibles d"être lésées par des manquements aux obligations de publicité et de mise en concurrence auxquelles le marché est soumis peuvent saisir le tribunal de grande instance de Fort-de-France d"un recours en contestation de la validité du contrat.

              Le référé contractuel ne peut pas être exercé si l"acheteur a respecté le délai de 11 ou 16 jours précité. Si le juge du référé pré-contractuel a été saisi, le référé contractuel ne peut être exercé si l"autorité délégante n"a pas signé le marché avant la décision du juge pré-contractuel et s"est conformée à cette décision.

              Ce recours peut être formé dans un délai de 31 jours, à compter de la publication d"un avis d"attribution du contrat au JOUE ou 6 mois, à compter du lendemain du jour de la conclusion du contrat, si aucun avis d"attribution n"a été publié.

              Action en nullité:

              Un recours en nullité peut être formé devant le tribunal de grande instance de Fort-de-France par une entreprise évincée de la conclusion du marché pendant dans un délai de 5 ans à compter de la connaissance de la conclusion dudit marché.
